Terms of Use (End-User Licence Agreement) – Mafiosi: Heist Empire

1. Who we are and what these Terms cover
These Terms govern your use of the mobile game Mafiosi: Heist Empire ("the game"), including its online features, in-game items and support. The game is provided by TomicSwissTech, Inh. Tomic, Grenzstrasse 25, 9430 St. Margrethen, Switzerland, VAT no. CHE-192.510.580 MWST, e-mail info@tomicswisstech.ch ("we", "us").
By installing or using the game you accept these Terms. If you do not accept them, do not use the game. Our Privacy Policy (https://mafiosi-heist-empire.pages.dev/privacy/) explains how we handle personal data. It is not part of this contract but applies alongside it.
2. App store terms
You obtain the game from Apple's App Store or Google Play. The terms of that store (for Apple the Media Services Terms and, unless these Terms replace it, the Licensed Application End User License Agreement, "Apple's standard EULA"; for Google the Google Play Terms of Service) also apply to your download and your purchases. If these Terms and the store's terms conflict on how the game is licensed or paid for, the store's mandatory terms prevail. §17 and §18 contain the additional terms the stores require.
3. Age and parental consent
The game is meant for players aged 13 and over and is not directed at children under 13. The store page shows its age rating for your country. If you are under the age of majority in your country, you may use the game only with the consent of a parent or guardian, who accepts these Terms on your behalf and is responsible for your purchases. Parents can control purchases with the store's family settings (for example Apple's Ask to Buy or Google Play purchase approvals).
4. Your licence
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the game on devices you own or control, for your private, non-commercial entertainment. All rights not expressly granted remain with us and our licensors. You may not sell, rent, sublicense or distribute the game, and you may not copy, modify or reverse-engineer it except where the law expressly allows this despite this restriction (for example for interoperability).
5. Your game account
The game creates a game account for you automatically on first launch. It is linked to credentials stored securely on your device, and no registration is needed. Keep your device secure. If you lose the device or delete the app data, you may lose access to the account unless your progress is synced (cloud save, and on Apple devices iCloud). Purchases remain tied to your Apple ID or Google account and can be restored with Restore Purchases. You may not use several accounts to manipulate leagues or rewards (§10). Accounts may not be sold, traded or shared. You can delete the account and its data at any time in Settings > Delete my data (see the Privacy Policy).
6. Virtual currency and in-game items
- The game contains virtual currency (for example Gold, Cash, Parts, Intel, Nerve, Event Tokens) and virtual items (for example masks, weapons, capos, passes). You receive a limited licence to use them in the game. You do not own them. They have no monetary value, are not legal tender, cannot be exchanged for money or anything outside the game, and cannot be transferred, sold or traded between players or outside the game.
- Purchased Gold does not expire. Earned currencies can have limits described in the game (for example Event Tokens at the end of an event, with advance notice).
- Everything we sell shows its contents before purchase. We do not sell randomized items for real money or for Gold.
- If a technical error credits you currency or items you did not earn or pay for, we may correct the balance. If a payment is reversed (refund or chargeback), we may remove what it paid for.
- Balance changes to the game (for example prices in Gold, drop rates of free rewards, strength of items) can change the in-game value of virtual items. §11 applies to changes that significantly affect paid content.
7. Purchases
- In-app purchases are made through Apple or Google. The price, taxes and payment are shown and handled by the store. Refunds follow the store's refund process (for Apple: reportaproblem.apple.com; for Google: the Google Play refund policy). This does not limit any mandatory rights you have under §7.4 and §13.
- Don's Card is a 30-day benefit bought once. It does not renew automatically. Buying it again extends the running period by 30 days. It works on all devices where you restore your purchases. If we offer auto-renewing subscriptions in the future, the price, period and how to cancel are shown before purchase, and you manage them in your store account settings.
- Passes, cards and packs give exactly the contents and duration described in the game at the time of purchase. Season passes apply to the season named in the product.
- Right of withdrawal (EU/UK consumers): digital content is delivered immediately after purchase. By buying, you ask for immediate delivery and acknowledge that you lose your right of withdrawal once delivery has begun, as far as the law allows this. The store asks for this confirmation where required.
8. Ads
The game shows ads, including optional rewarded ads that you choose to watch for an in-game reward. Rewards are granted only when the ad was shown in full and within the daily limits shown in the game. Any purchase switches off interstitial ads (ads between screens) for the account. Rewarded ads stay optional. Ads come from third parties. You can report an inappropriate ad in Settings > Report an ad.
9. Leagues, leaderboards and fair play
- Weekly leagues and leaderboards show a generated display name, the icons of your equipped mask and capo, your score and your rank. Opponents are real players. The game never uses bots in leagues.
- Rewards are in-game only. There are no prizes of monetary value.
- Results are checked automatically for plausibility. Implausible results can be put "under review", hidden from other players and excluded from rewards. After a review we may confirm, correct or remove results, league tiers or rewards. You can ask for a manual review at info@tomicswisstech.ch.
10. Rules of conduct
You may not:
- cheat, use bots, scripts, modified clients, memory editors or exploits, or manipulate the device clock, save files or network traffic to gain an advantage;
- create or use several accounts to manipulate leagues or rewards;
- interfere with or overload our servers, or try to access other players' data;
- sell, buy or trade accounts, currency or items, or offer "boosting" services;
- use the game for any unlawful purpose or in a way that infringes others' rights.
If you break these rules, we may, in proportion to the breach, remove the advantage gained, reset results, exclude you from leagues or leaderboards, or suspend or terminate your access to online features. Except in serious or repeated cases, we warn you first. Purchased items remain available for offline play unless the breach concerns them, subject to mandatory law.
11. Changes to the game, availability and end of service
- We develop the game further. We may change, add or remove content and features for valid reasons, such as balance, security, technical or legal requirements, or new content. We do this without extra cost to you. If a change significantly and negatively affects your access to or use of content you paid for, we will tell you in advance, and where the law gives you a right to terminate or a refund, you keep it.
- Most of the game works offline. Online features (cloud save, leagues, leaderboards, remote events) require an internet connection and our servers, and they may occasionally be unavailable.
- If we decide to discontinue the online features or the game, we will announce it in the game and on our website at least 60 days in advance and stop selling Gold and other items when we announce it. As far as the platform allows, the offline game remains playable on your device after that. Mandatory consumer rights to a (partial) refund for paid content remain unaffected.
12. Intellectual property and third-party content
The game, its code, characters, story, texts, artwork, music selection and trademarks are owned by us or our licensors. The game uses licensed third-party assets (among others Synty Studios art assets) and music and some sound effects by Kevin MacLeod (incompetech.com) under the Creative Commons Attribution 4.0 licence, sound effects by Little Robot Sound Factory and Joe DeShon under Creative Commons Attribution 3.0, and public-domain (CC0) sound effects. The full credits are in Settings > Credits and licences. Share cards you create from the game may be shared for private, non-commercial purposes.
13. Warranty and liability
- We provide the game with the care of a diligent developer, but we cannot guarantee that it will always be available or free of errors. Your statutory rights (in particular warranty and conformity rights for paid digital content) remain unaffected.
- We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and wherever mandatory law excludes a limitation.
- Otherwise, to the extent permitted by law, our liability for slight negligence is limited to foreseeable damage typical for this kind of contract and, in total, to the amount you paid us for in-app purchases in the 12 months before the damage occurred. We are not liable for indirect damage, lost profits or lost data where you could have avoided the loss by syncing or restoring.
- Nothing in these Terms limits the liability of Apple or Google under their own terms, or your mandatory rights as a consumer.
14. Termination
You can stop using the game at any time and delete your data in Settings > Delete my data. We can end this licence for serious or repeated breaches of §10 under the conditions set out there. §6.1, §12, §13 and §16 survive termination.
15. Privacy
We process personal data as described in the Privacy Policy (https://mafiosi-heist-empire.pages.dev/privacy/).
16. Governing law and place of jurisdiction
- These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
- The place of jurisdiction is St. Margrethen (Canton of St. Gallen), Switzerland, the seat of the publisher, subject to §16.3.
- Consumers: if you use the game as a consumer, you keep the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of your place of residence. We can bring proceedings against you only in the courts of your place of residence where the law so provides. If you live in Switzerland, the Swiss rules on consumer contracts apply (including Art. 32 of the Civil Procedure Code on your local court). This clause does not deprive you of any rights that cannot be waived by contract.
17. Additional terms for the Apple App Store
If you obtained the game from the App Store, the following also applies:
- These Terms are concluded between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the game and its content.
- The licence in §4 is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with the purchaser through Family Sharing or volume purchasing may also use the game where Apple's rules allow it.
- We are solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the game.
- If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the game. To the maximum extent permitted by law, Apple has no other warranty obligation for the game. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not excluded under these Terms and the law.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the game or your possession and use of it, including product liability claims, claims that the game fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar legislation.
- If a third party claims that the game or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of the claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about the game go to us: TomicSwissTech, Inh. Tomic, Grenzstrasse 25, 9430 St. Margrethen, Switzerland, info@tomicswisstech.ch.
- You must comply with applicable third-party terms when using the game (for example your mobile data contract).
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. Additional terms for Google Play
If you obtained the game from Google Play, the Google Play Terms of Service and Google Play's refund policies also apply to your download and purchases. Google is not a party to these Terms and is not responsible for the game.
19. Final provisions
- If a provision of these Terms is invalid, the rest remains valid. The invalid provision is replaced by the valid provision that comes closest to its purpose, as far as the law allows.
- We may update these Terms for valid reasons (for example new features, legal changes). We will announce material changes in the game at least 30 days before they take effect. If you keep using the game after that, the new Terms apply. If you do not agree, you can stop using the game and delete your data. Changes never apply retroactively to purchases already made.
- These Terms are available in English, German, French, Korean, Portuguese (Brazil) and Malay. If the versions differ, the English version prevails, unless mandatory law in your country requires otherwise.
- We may transfer this contract to a successor of our business, provided your rights are not reduced. We will inform you of such a transfer.
